DATE, TIME, PLACE OF MEETING
 

The Calcasieu Parish School Board met in the Conference Room of the Calcasieu Parish School Board located at 1732 Kirkman Street, Lake Charles, Louisiana, on Tuesday, May 8, 2001, at 5:00 p.m. The meeting was called to order by Sheral A. LaVergne, President. The prayer was led by James W. Karr, Sr.; John Falgout led the Pledge of Allegiance.
 

ROLL CALL
 

The roll was called and the following members were present:

On motion by Mr. Doucet, seconded by Mrs. Duplechin and unanimously carried, the minutes of the regular meeting of April 3, 2001, were approved as presented.

On motion by Mr. Victorian, seconded by Mrs. Duplechin and unanimously carried, the Supplemental Agenda was included as part of the regular agenda.

Ms. LaVergne recognized the McNeese Education 201 class members who were in attendance.
 

PRESENTATIONS
 

XChange Project Update
 

The Chair recognized Sheryl Abshire who gave a brief synopsis of the XChange Project. Mrs. Abshire said that Calcasieu Parish was one of five districts in the nation selected for the project and was the first to bring the new website live.
 

Zaner-Bloser State Handwriting Contest Winners
 

Greg Thomas, Zaner Bloser representative was recognized by the Chair. Mr. Thomas stated he appreciated the opportunity to once again appear before the Board. He said that Calcasieu has had State level winners for several years; this year, Calcasieu Parish swept the competition for the State of Louisiana. Mr. Thomas said that was quite a feat. He stated that
over 9,900 students participated statewide in the contest. Mr. Thomas then announced the runner-ups and presented each with a certificate.

Science Screen Report
 

Dolores Hicks, Administrative Director of Elementary Schools thanked ARCH Chemicals and Rick Walden, Plant Manager for their generosity in purchasing a site license for the Science Screen Report for Kids, elementary level videos. Some of the videos in the Millennium Series included topics such as Saving the Earth’s Animals, Transportation in the Next Century, Robots, Our Future Servants and Space Exploration in the New Millennium. The schools not only received a copy of the video but also a lesson plan, including follow-up web sites and a student evaluation. One hundred seventy-five copies were placed in school libraries, classrooms or science labs at schools.  
Mr. Walden thanked Mrs. Hicks and the Calcasieu Parish School Board for the honor and said the program would remain in place next year.

Perfect Attendance Awards
 

Keith LeLeux, Child Welfare & Attendance Supervisor announced that two students from Calcasieu Parish Schools had perfect attendance for twelve years. Mr. LeLeux stated that it was a pleasure to represent the Child Welfare and Attendance Department in presenting 12-year Perfect Attendance Certificates to Stacey Reeves, Vinton High School and Amanda Gail Hardy, Sulphur High School.
 

Calcasieu Parish Counselor of the Year
 

Roger Creel, Supervisor of Vocational Education, said that Calcasieu Parish Counselors were some of the most dedicated and important people in the education system. They do a tremendous job working with teachers and students.
 

Mr. Creel presented plaques to each of the following:

Ursula Natali, J. I. Watson Middle School, Middle School Division Counselor of the Year.
 

Trudy Hutton, Barbe High School, High School Division and Outstanding Counselor of the Year.
 

Each counselor will represent the district at the state competition for Counselor of the Year.
 

Trudy Hutton, High School Counselor of the Year and Outstanding Counselor of the Year said she appreciated the fact that she was nominated for the honor by her peers. She thanked the very special people in her life who had helped make it possible for her to receive the award, her mother and father, her husband and her two sons, Chad and Wes.
 

COMMITTEE REPORTS
 

Budget/Fiscal Management Committee
 

John Falgout, Chair, reported that the Budget/Fiscal Management Committee met on Tuesday, April 11, 2001; a quorum was present.
 

A presentation was made to the Committee by Don Manuel, Calcasieu Parish Police Jury Member on the future of Moss Bluff Middle School property once the school has moved to its new location. The Police Jury advised that they were interested in the purchase of the facility for use as a multi-purpose and recreational facility. Mr. Manuel asked that the Board consider giving the Police Jury first choice for a possible Cooperative Endeavor Agreement to purchase the facility when and if it becomes available and that the sale be for the current appraised value of $550,000.
 

A motion was made and seconded in Committee to recommend that staff be authorized to negotiate with the Calcasieu Parish Police Jury for the sale of the old Moss Bluff Middle School property when the school board chooses to sell the property.
 

Mr. Fontenot advised the Committee that the sale could not take place until the premises had been vacated and the school board agreed to sell the facility if they no longer had any use for the building. He also advised that the sale would be for the appraised value and asked that all expenses incurred by Sales Tax District #3 be reimbursed at the time of the sale.
Motion was then voted on and carried.
 

Mr. Falgout moved, on behalf of the Committee, to authorize staff to negotiate with the Calcasieu Parish Police Jury for the sale of the old Moss Bluff Middle School property when the school board chooses to sell the property. Motion carried unanimously.
 

An overview of the 2001-2002 Budget Process for the General Fund Budget was presented by Karl Bruchhaus, Chief Financial Officer. Staff requested that the Committee recommend setting the projected General Fund revenues and allowable expenditure level for fiscal year 2001-2002. If Board Members have specific items they want to address in the budget process, they should contact him.
 

It was moved, seconded and carried that the 2001-2002 General Fund Projected Revenues be set at $167,398,475 and the General Fund Allowable Projected Expenditures be set at $167,398,475 as presented.

The next item of discussion was the acceptance of Third Party Services to monitor compliance for IRS 403(b) (tax sheltered annuities) plans, 457 (deferred compensation), and 125 (cafeteria plan). Staff recommended that the School Board remain with the current provider of service, Employer’s Administrative Corporation of Lake Charles, for the Section 125 Cafeteria Plan. Mr. Bruchhaus advised the Committee that no Board action was required when continuing the contract. Staff recommended employing Werntz and Associates of Shreveport to provide tax sheltering compliance consulting services at an estimated $30,000, to be funded in the 2001-2002 General Fund Budget.

A resolution opposing proposed legislation to centralize collections of local sales and use taxes by the State of Louisiana Department of Revenue was presented for approval. This resolution was previously approved by the Board several years ago, however, some facts and figures have changed since that time.
 

By motion, second and a unanimous vote, the Committee approved the resolution opposing centralized collections of local sales and use taxes by the State of Louisiana Department of Revenue and that a copy of the resolution be sent to Calcasieu Parish’s legislative delegation. Mr. Falgout moved, on behalf of the Committee to approve the resolution opposing centralized collections of local sales and use taxes by the State of Louisiana Department of Revenue and that a copy of the resolution be sent to Calcasieu Parish’s legislative delegation , as presented. Motion carried unanimously.  
 

RESOLUTION
 

WHEREAS, the Constitution of the State of Louisiana grants local governments the right to levy and collect local sales and use taxes; and
 

WHEREAS, sales and use tax revenues for the Calcasieu Parish School Board, represent approximately 81% of our tax revenues; and
 

WHEREAS, local administration and collection of sales and use taxes are the best means to protect our most important revenue source; and
 

WHEREAS, local governments do not wish to be dependent on outside agencies to manage this critical function; and
 

WHEREAS, Senator Michot has prefiled proposed legislation in the form of Senate Bills 170, 171 and 193 to have the State of Louisiana collect local sales and use taxes; and
 

WHEREAS, Senator Boissier and Representative McManus have introduced proposed legislation in the form of Senate Bill 909 and House Bill 1493, respectively, calling for unprecedented revisions to administrative provisions and procedures that can only be viewed as detrimental to local authority over their most important source of local revenues and establishing added levels of bureaucracy at the state level to usurp local control and administration over sales and use tax matters, as well as the costs associated therewith.
 

NOW THEREFORE BE IT RESOLVED, that the President and members of the Calcasieu Parish School Board urge and request every member of the Calcasieu Parish Legislative delegation to vigorously support local administration and collection of sales and use taxes.
 

BE IT FURTHER RESOLVED, that a copy of this resolution will be sent to the Calcasieu Parish Legislative delegation so that they will be made aware of our position on this matter.

The next item dealt with a resolution involving the issuance of $3,000,000 in excess revenue certificates for the classroom facilities project. Mr. Bruchhaus advised the Committee that if they chose to issue the certificates, for every $1.2 million in riverboat funds collected annually, $900,000 must be allocated to repay the debt. The current cash balance available after all current projects have been completed will total approximately $525,000. He asked for direction from the Board for setting new priorities and advised the Committee that he could develop a priority list to bring to the Committee before addressing the sale of bonds.
A motion was made, seconded and approved that no action be taken on the resolution authorizing the issuance of $3 million of bonds until staff reprioritized obligations on riverboat proceeds.

Administration & Personnel Committee
 

Randy Armentor, Chair, reported that the Administration and Personnel Committee met on Tuesday, April 24, 2001; a quorum was present.
 

The first item of discussion was Resource Officers for Calcasieu Parish Schools. The program was designed to provide an environment in the schools that is orderly, safe and secure. Staff strongly recommended that the Board enter into a Joint Services Agreement with the Calcasieu Parish Sheriff's Department to initiate a Safe School Program (SSP). It was proposed by staff to enter intro the Joint Services Agreement to provide resource officers on either a full or part-time basis at all school sites with assignment contingent upon size and administrative request.
 

Sheriff Beth Lundy presented an overview of the proposed Safe School Program. Sheriff Lundy stated that the Sheriff's Department was willing to encumber the majority of the cost of the program.
 

Motion was made, seconded and carried in Committee to refer the concept of the SSP to the Budget/Fiscal Management Committee for funding.
 

Mr. Armentor so moved on behalf of the Committee.
 

Mr. Doucet expressed concerns about placing Resource Officers in schools when all schools did not have full-time counselors in place.
 

Motion was voted on and carried by majority vote. Mr. Doucet voted nay.
The next agenda item was to review revised Policy File: JGCC (Student Health Services (Communicable Disease Control). (Revised Part II Only.) The policy was not discussed and will be brought to Committee at a later date.
 

A review of the revised School Medication Form (Policy File: JGCD) was the next item of discussion. Changes were presented for consideration by Janis Ehlers and Mary Guillory, Coordinators of School Nurses. The revisions were presented.
 

 
Mr. Robert then amended the motion, seconded by Mr. Pitre, to authorize legal counsel and staff to incorporate all corrections and comments upon returning the revised policies to the full Board for approval. Motion, as amended, carried by majority vote.
 

The main motion was then voted on and carried with Mr. Victorian voting against the motion.

Medication Given at School
Absolutely no medicines shall be given internally, externally, or by injection at school without written instructions from a physician/dentist/certified nurse practitioner and written permission from a parent/legal guardian. Aspirin and Tylenol are medications. A teacher or any other employee of the school system giving a student Aspirin or Tylenol could be charged with practicing medicine.
 

NOTE: It is suggested that school personnel talk with the
parent/legal guardian about medication administration and
school board policy. If possible, advise them to give medication at home on a schedule other than during school hours.
 

I. When medication has to be given at school, it must be the duty of the principal to proceed as follows:
 

A. Designate at least two employees in addition to himself/herself
to receive training and administer medications in each school.
 

B. Obtain appropriate medication and a written request from the
parent/legal guardian prior to giving any medication. Obtain a
written request from the physician/ dentist/ certified nurse
practitioner that states that medication needs to be
administered during school hours. Only the
Physician/dentist/certified nurse practitioner or his/he
Staff may write on the medication order form. This form must
be signed by the physician/dentist/certified nurse
practitioner. FAXED ORDERS MAY BE ACCEPTED;
ORIGINAL ORDERS MUST BE RECEIVED WITHIN (5)
BUSINESS DAYS.
 

C. Be sure that the medication bottle has only one kind of
medication in it and that each bottle is properly labeled with
the child’s name, physician/dentist/certified nurse practitioner, pharmacy, drug, dosage, and designated time(s) for administering. IF MEDICATION IS NOT PROPERLY LABELED AND DOES NOT MATCH EXACTLY THE
PHYSICIAN’S ORDER, IT MUST NOT BE GIVEN.  
D. Maintain a medication log in the school for any medicine
administered. See that the administration of all medication is
properly supervised and documented. Each administration of
medication must be recorded on a medication log which includes the date and time each medication was given, the dosage administered, and the signature of the person ad-
ministering the medication. It must be the responsibility of the
principal to assign designated personnel to administer
medication at each school.
 

E. Keep medication in a safe place away from all children. Due to
the potential of drug abuse, medication MUST be kept under
lock and key in a secure, central location. Students must not
be allowed to have any drugs in their possession on the
school ground or in school vehicles.
 

F. A school employee must observe each student for a
period of 45 minutes following the administration of
medication. This observation may occur during instruction
time.
 

G. Relieve the person administering medication of all other duties
during the period when the medication is being administered.
The requirement does not include the observation period
required in I-F. The local school board must determine how to
implement this requirement.
 

H. Allow parent/legal guardian to come to school to administer,
only to their own children, medication, such as Tylenol, for an
unexpected toothache. The parent/legal guardian will
be required to log the medication.
 

I. Allow self-medication under certain circumstances (such as a
student who administers his/her own insulin). This self-
administration will be subject to school regulations.
 

J. Keep no more than a 20-school-day supply of medication at
school.
 

K. Don’t give injectable medication at school except in an emergency situation. There must be written instruction from a
physician/dentist/certified nurse practitioner; there must be
written permission from the parent/legal guardian for the
procedure; and the injection must be given by appropriately unlicensed, but trained, school personnel.
 

L. If there are any questions, discuss these concerns with the
school nurse.
 

 
 

 
II. Role of the School Nurse
 

A. The school nurse, in collaboration with the principal, shall
supervise the implementation of the school policies, for the administration of medications in schools, to insure the safety, health and welfare of the students.
 

B. The school nurse must be responsible for the training of
non-medical personnel who have been designated by each
principal to administer medications in each school. The training must be at least six hours and include, but not be limited to, the following provisions:
 

1. Proper procedures for administration of medications,
including controlled substances
 

2.  Storage and disposal of medications
 

3. Appropriate and correct record keeping
 

4. Appropriate actions when unusual circumstances or
medication reactions occur

5. Appropriate use of resources
 

C. The school employee, physician/dentist/certified nurse practitioner, or registered nurse must assess the health status of the specific child in his/her specific education setting to determine if the administration of the medication can be safely performed by, and delegated to, unlicensed, but trained, school personnel.
 

III. Role of the Teacher

The classroom teacher who is not otherwise previously contractually
required shall not be assigned to administer medications to students.
A teacher may request in writing to volunteer to administer
medications to his/her students. The administration of medications
shall not be a condition of employment for teachers employed
subsequent to July 1, 1994. A regular education teacher who is
assigned an exceptional child, shall not be required to administer
medications.
 

 IV. Clarification of CPSB Administrative Policy (JGCD)
 

Provision for a written medication administration record to be
on file at school must include:

A. the student’s name;  
B. clear instructions for school administration;
 

C. Rx number, if any;
 

D. current date;
 

E. student’s diagnosis;  
F. name, amount of each school dose, time of school administration, route of medication, and reason for use of medication;
 

G. physician’s/dentist’s/certified nurse practitioner’s name;  
H. parent’s/legal guardian’s printed name and signature;  
I. parent’s/legal guardian’s emergency phone number;
J. statement granting or withholding release of medical
information;
 

K. any unusual circumstances, actions, or omissions, and
reactions;
 

L. documentation of desired and adverse effects;
 

M. person(s) administering medication signature and title;
 

N. a requirement for emergency protocols for medication-
related reactions;
 

O. a requirement that the school nurse, in consultation with
the school principal, must provide for storage of
medication in a locked area with limited access by
authorized personnel.
 

P. ** ALL DOCUMENTATION SHALL BE RECORDED IN INK AND MUST NOT BE ALTERED. If there are to be any correction and/or changes on the record forms, a single line must be drawn through the error, and the person documenting this change must initial the correction.

ADMINISTRATION OF MEDICATION
 

The administration of medication to students must be in compliance with the requirements of R.S. 17:436.1, and the policy established by the Louisiana Board of Elementary and Secondary Education (BESE). It shall be the policy of the School Board that no school employee other than a registered nurse or licensed medical physician shall be required to administer medication until all the following conditions have been met. As used in this policy, the term “medication” must include all prescription and non-prescription drugs.  
I. WRITTEN ORDERS, APPROPRIATE CONTAINERS, LABELS, AND
INFORMATION
 

A. Medication must not be administered to any student without an order from a physician/ dentist/certified nurse practitioner licensed to practice medicine in Louisiana or an adjacent state, and it must include the following information:
 

1. the student’s name 2. the name and signature of the physician/dentist/certified nurse practitioner
3. physician’s/dentist’s/certified nurse practitioner’s business address, office phone number, and emergency phone numbers 4. student’s diagnosis 5. name, amount of each school dose, time of school
administration, route of medication, and reason for use of
medication
6. a written statement of the desired effects and the child's
specific potential adverse effects.
 

B. Medication must be provided to the school by the parent/legal
guardian in the container that meets acceptable pharmaceutical
standards and must include the following information:
 

1. name of pharmacy
2. address and telephone number of pharmacy
3. prescription number
   4. date dispensed
5. name of student
6. clear directions for use, including the route, frequency,
and other as indicated
7. drug name and strength
8. last name and initial of pharmacist.
9. cautionary auxiliary labels, if applicable
10. physician’s/dentist’s/certified nurse practitioner’s name  
Labels of prepackaged medications, when dispensed, must
contain the following information in addition to the regular
pharmacy label:
 

1. drug name
2. dosage form
3. strength
4. quantity
5. name of manufacturer and/or distributor
6. manufacturer’s lot or batch number  
II. ADMINISTRATION OF MEDICATION: GENERAL PROVISIONS
 

A. Once trained, the school employee, who administers medication, may not decline to perform such service at the time indicated, unless exempted in writing by the MD or RN.
 

B. During the period when the medication is administered, the person
administering medication must be relieved of all other duties. This
requirement does not include the observation period required in
II.- E. The local school systems must determine how to implement
this requirement.
 

C. Except in life-threatening situations, unlicensed, but trained,
school personnel may not administer injectable medications.
 

D. All medications must be stored in a secured locked area or
locked drawer with limited access except by authorized school
personnel.
 

E. Only oral, inhalant, topical ointment for diaper rash, and
emergency medications must be administered at school by
unlicensed, but trained, school personnel. Topical ointment – A student with a chronic skin condition, that requires the application
of an ointment, can apply the ointment to themselves. The
parent/legal guardian must comply with the Calcasieu Parish
School Board Policy regarding medication administration including
the medication self-administration form signed by the physician/dentist/certified nurse practitioner.
 

F. Each student must be observed by school personnel for a period of
45 minutes following the administration of medication. This
observation may occur during instruction time.
 

G. School medication orders must be limited to medications which
cannot be administered before or after school hours.
 

III. PRINCIPAL
 

The principal must designate at least two employees to receive
training and administer medications in each school.
 

 IV. TEACHER
 

The classroom teacher who is not otherwise previously contractually required shall not be assigned to administer medications to students. A teacher may request in writing to volunteer to administer medications to his/her own students. The administration of medications shall not be a condition of employment of teachers employed subsequent to July 1, 1994. A regular education teacher who is assigned an exceptional child shall not be required to administer medications.
 

 V. SCHOOL NURSE

A. The school nurse, in collaboration with the principal, must
supervise the implementation of the school policies for the
administration of medications in schools to insure the safety,
health and welfare of the students.
 

The school nurse must be responsible for the training of non-
medical personnel who have been designated by each principal to
administer medications in each school. The training must be at
least six hours and include but not be limited to the following
provisions:
 

1. Proper procedures for administration of medications including
controlled substances
2. Storage and disposal of medications
3. Appropriate and correct record keeping
4. Appropriate actions when unusual circumstances or
medication reactions occur
5. Appropriate use or resources
 

VI. PARENT/ LEGAL GUARDIAN
 

A. The parent/legal guardian who wishes medication administered
to his/her student must provide the following:
 

1. A letter of request and authorization that contains the
following information:
 

a. the student’s name; b. clear instructions for school administration;
c. Rx number, if any;
d. current date
e. students’ diagnosis f. name, amount of each school dose, time of school
administration, route of medication, and reason for use of medication
g. physician’s/dentist’s/certified nurse practitioner’s name; h. the parent’s/legal guardian’s printed name and signature i. parent’s/legal guardian’s emergency phone number; j. statement granting or withholding release of medical
information
 

2. A written order for each medication to be given at school,
including annual renewals at the beginning of the school
year. The new orders dated before July of that school year
will not be accepted. No corrections will be accepted on
the physician’s medication order form. Alteration of this form in any way or falsification of the signature are
grounds for prosecution. Orders for multiple
medications on the same form, an incomplete form, or
a form with a physician’s/dentist’s/certified nurse practitioner’s stamp will not be accepted. FAXED ORDERS MAY BE ACCEPTED; ORIGINAL ORDERS
MUST BE RECEIVED WITHIN (5) BUSINESS DAYS.

3. A prescription for all medications to be administered at
school, including medications that might ordinarily be
available over-the-counter. Only the physician/dentist/
certified nurse practitioner or his/her staff may write on
the medication order form. This form must be signed by
the physician/dentist/certified nurse practitioner.
 

4. A list of all medications that the student is currently receiving
at home and at school, if that listing is not a violation of confidentiality or contrary to the request of the parent/legal
guardian or student.
 

5. A list of names and telephone numbers of persons to be
notified in case of medication emergency in addition to the
parent/legal guardian and licensed physician/dentist/certified
nurse practitioner.
.
6. Arrangements for the safe delivery of the medication to and
from school in a properly labeled container as dispensed by
the pharmacist; the medication must be delivered by
a responsible adult. The parent/legal guardian will need
to get two containers for each prescription from the
pharmacist in order that the parent/legal guardian,
as well as the school, will have a properly labeled
container. If the medication is not properly labeled and
does not match the physician’s order exactly, it will not be given.
 

B. All aerosol medications must be delivered to the school in pre
measured dosage.
 

C. Provide no more that 20 school day supply of medication in a
properly labeled container to be kept at school.
 

D. The initial dose of a medication must be administered by the
student’s parent/legal guardian outside the school jurisdiction with sufficient time for observation for adverse reactions.
 

E. The parent/legal guardian must work with those personnel
designated to administer medication as follows:

1. Cooperate in counting the medication with the
designated school personnel who receives it and sign the
Drug Receipt form.
 

2. Cooperate with school staff to provide for safe, appropriate
administration of medications to students, such as positioning, and suggestions for liquids or foods to be given
with the medication.
 

3. Assist in the development of the emergency plan for each
student.
 

4. Comply with written and verbal communication
 regarding school policies.
 

5. Grant permission for school nurse/physician/dentist/certified
nurse practitioner consultation.
 

6. Remove or give permission to destroy unused,
contaminated, discontinued, or out-of-date
medications according to the school guidelines.
 

VII. STUDENT CONFIDENTIALITY
 

ALL STUDENT INFORMATION MUST BE KEPT CONFIDENTIAL.
 

VIII. KNOWN HEALTH PROBLEMS

If a child has a known problem that is potentially serious and there is a method of helping the child and the school is denied an opportunity to help the child because the necessary materials are not made available, then the school cannot be held responsible to assist the child. Therefore, the child should be excluded from the school until said materials are made available.
 

ASTHMA
 

Current policy of the Calcasieu Parish School System does not
permit a student to carry any medication at school or to self-
administer medication at school without proper authorization.
 

In order for a child with asthma to be permitted to carry an inhaler at
school, the school must receive a written statement from a
physician/certified nurse practitioner stating (1) that the child does
have asthma and (2) that he or she should carry an inhaler at
school/ field trip.
 

In addition, trained, unlicensed school personnel that administer
medication must be inserviced on Asthma protocol.
 

If the child no longer needs to carry an inhaler at school or on a field
trip, the school must receive a written statement from the
physician/certified nurse practitioner to that effect or the child will not
be allowed to attend the school/field trip.
 

The only exemption to the field trip requirement is that either the
parent/legal guardian or their adult designee may attend the field trip
with the child.

IX. FIELD TRIPS
 

If the parent/legal guardian of a student normally on medication does
not request in writing that medication be administered on a pending
field trip then no School Board employee shall be responsible for
administering medication to the student on the field trip. If the
parent/legal guardian does not provide the required paperwork and
medication (whether taken at school/home or both) to the school,
prior to the field trip, then the student can not attend the field trip.
 

If the parent/legal guardian of a student requests in writing that
medication be administered on a pending field trip, then:
 

1. a person certified to administer medication must go on the field
trip; and

2. a nurse must be on-call while the field trip is being taken.
 

In the event that a certified School Board employee is not
available, the parent/legal guardian or a non-School Board
employee designee (designated in writing by the parent/legal
guardian) should attend the field trip to administer medication.
 

In the event that a certified School Board employee is not available,
and neither the parent/legal guardian nor their designee can attend
the field trip to administer medication, then the field trip cannot be taken.
 

X. Extended Day Care:
 

In the event that a student attends extended day care and requires
medication outside school hours (before or after school),
medication orders, that include the dosage(s), time(s), and medication(s), must be obtained from the physician/dentist/certified nurse practitioner.

XI. LEAP Testing: This will be addressed at a later date by Mr.
James Spruel and Mrs. Barbara Bankens.

The next item of discussion was a "Free Zone" for Westlake area schools.
A map was reviewed by the Committee regarding a "free zone" for Westlake area schools. Mr. Doucet stated that approval from the Board would give students living in the following geographical locations permission to attend the Westlake area schools:
 

1. south side of High Hope Road east to Willow Springs Road
2. Houston River Road and roads feeding into Houston River Road
3. Anthony Ferry Road between Houston River Road and High Hope Road
4. East side of Highway 27 N between Houston River Road and High Hope Road
 

After a brief discussion, it was moved, seconded and approved to establish a "dual zone" for those schools as indicated above.
 

Mr. Armentor moved, on behalf of the Committee to approve the "dual zone" for schools indicated.
 

 
Mr. Doucet stated that residents of the area had requested that he bring this matter to the Board for a dual zone status in that area. He assured that it would not be a drain on the Sulphur schools and that those residents should be able to voice their opinion as to where their children attended school.
 

Further discussion followed with several principals of the affected area speaking against the dual zone concept. In addition, several Board Members spoke against the concept stating that a procedure was in place (the Out of Zone Request) that was working effectively and there was no need for the approval of a dual zone in that area.
 

After further discussion, the motion was voted on and failed for lack of a majority vote. Yeas: Mr. Armentor, Mr. Doucet, Mr. Falgout, C. Duhon, Mr. Robert and Ms. LaVergne. Nays: Mr. Victorian, Mr. Blackwell, J. Duhon, Mrs. Duplechin, Mr. Karr and Mr. Pitre.
 

The next item of discussion was Policy File GBRIB: ILLNESS.
 

Wayne Savoy, Assistant Superintendent of Human Resources/Auxiliary Services, addressed the Committee regarding paragraph 4 of the policy which read: "an employee who is absent for six (6) or more consecutive days shall be required to present a certificate from a physician certifying such absences upon return to work". He stated there was nothing in policy stating what actions would be taken by the Payroll Department should an employee fail to present a certificate from a physician.
 

It was recommended by staff that an employee missing six (6) or more consecutive days who failed to submit a certificate from a physician shall be docked a full day's pay beginning on the 6th consecutive day of the absence and each consecutive day thereafter until the employee returned to work.
 

Mr. Blackwell moved, was seconded by Mr. Doucet and unanimously carried, to accept the recommendation of staff contingent upon advice of legal counsel.
 

Mr. Armentor moved on behalf of the Committee to approve the revisions to Policy File GBRIB: ILLNESS, Sick Leave, as presented by Committee. Motion was voted on and carried unanimously, contingent upon advice of legal counsel. Policy change is as follows:

SICK LEAVE
The School Board shall grant all employees hired for the school year or longer a minimum of ten (10) days absence per year because of personal illness or other emergencies without loss of pay in accordance with the following schedule:

Such leave, when not used, shall be allowed to accumulate to the credit of the employee without limitation. However, upon initial employment, a teacher employed by the Board shall not be allowed any sick leave until he reports for duty and actually performs work.
The minimum of ten days of sick leave for an employee shall be based on the employee beginning work at the beginning of the school year. In the case of an employee beginning work in the first month of the school year, ten days sick leave shall be allowed. If an employee begins work in the second month of the school year, nine days of sick leave shall be allowed. If an employee begins work in the third month of the school year, eight days of sick leave shall be allowed; if an employee begins work in the fourth month of the school year, seven days of sick leave shall be allowed; and the number of days of sick leave shall continue to be prorated for an employee who begins work until the eighth month of the school year, when only three days of sick leave shall be allowed. The Superintendent shall be responsible for developing and maintaining pertinent regulations and procedures governing sick leave.
All other employees (10, 11, and 12 month employees) will be given a minimum of 10, 11, or 12 days which will be based on the employee's hire date.
If hired after the appropriate starting time, their sick leave will be prorated from a schedule established by the Personnel Department.
An employee who is absent for six (6) or more consecutive days and fails to submit a certificate from a physician certifying the absences shall be docked a full days pay beginning on the 6th consecutive day of absence and each consecutive day thereafter, until the employee returns to work.
 

Upon the retirement of any teacher, bus operator, or school employee, or upon the teacher's, bus operator's, or school employee's death prior to retirement, the School Board shall pay the teacher, bus operator, or school employee or his/her heirs or assigns, for any unused sick leave, not to exceed twenty-five (25) days. Such pay shall be at the daily rate of pay paid to the employee at the time of his/her retirement or death.
If an employee is absent from duty under circumstances in which he/she is not entitled to any kind of leave, such employee shall be considered to be in violation of his/her contract, and is not entitled to be paid for the days of unauthorized absence and non-performance of duties.
SICK LEAVE FOR EMERGENCIES
Emergencies for sick leave purposes shall be defined by the Board as:
1. serious illness or disability of immediate family (spouse or children);
 

2. serious illness or disability of the employee's parents or those to the spouse, brothers and sisters or those of the spouse; or
 

3. wedding of the employee.
 

Emergencies not listed shall be considered by the Superintendent.
 

EXTENDED SICK LEAVE
 

The Board shall permit each teacher and bus driver to take up to ninety (90) days of extended sick leave in each six-year period of employment which may be used for personal illness or illness of an immediate family member at any time the teacher or bus driver has no remaining regular sick leave balance at the time the extended sick leave is set to begin. Immediate family member means a spouse, parent, or child of the teacher or bus driver.
Unused days during any six-year period of employment shall not cumulate or carry forward into the next six-year period of employment. The balance of days of extended sick leave available shall transfer with the teacher
 

or bus driver from one public school employer to another without loss or restoration of days.
Interruptions of service between periods of employment with a public school employer shall not be included in any calculation of a six-year period. Any employment with any public school employer, regardless of when it occurs, shall be included in any determination of the balance of days of extended sick leave available to the teacher or bus driver.
Any teacher or bus driver on extended sick leave shall be paid sixty-five percent (65%) of the salary paid the teacher or bus driver at the time the extended sick leave begins. Except for extenuating circumstances, a doctor's certificate shall be presented upon return to work.
Gainful Employment Permitted
 

A teacher or bus driver may undertake additional gainful employment while on extended sick leave, provided all of the following conditions are met:
 

1. The teacher or bus driver can demonstrate that he/she will be working not more than twenty (20) hours a week in a part-time job that the teacher or bus driver has been working for not less than one hundred twenty (120) days prior to the beginning of any period of extended sick leave.
 

2. The physician who certifies the medical necessity of the leave indicates that such part-time work does not impair the purpose for which the extended sick leave is required.
 

Any violation of the provisions regarding gainful employment may require the teacher or bus driver to return to the Board all compensation paid during any week of extended sick leave in which the teacher or bus driver worked more than twenty (20) hours and to reimburse the Board all related employment costs attributable to such period as calculated by the Board, without any restoration of leave days.
 

Application Process
 

On every occasion when a teacher or bus driver uses extended sick leave, a statement from a licensed physician certifying that the leave is medically necessary for the teacher or bus driver or that the immediate family member's illness is serious and requires the presence of the teacher or bus driver shall be presented prior to extended sick leave being taken, whenever possible.
 

1) If the Board, upon review of the application, questions the validity or accuracy of the certification, the Board may require the teacher, bus
 

2) driver, or the immediate family member, as a condition for continued extended sick leave, to be examined by a licensed physician selected by the Board.
 

3) If the Board selected physician disagrees with the original medical certification, then the employer may require the teacher, bus driver, or immediate family member, as a condition for continued extension of sick leave, to be examined by a third licensed physician, whose name appears next in the rotation of physicians on a list established by the local medical society and maintained by the Board. All costs of an examination and any required tests by a third doctor shall be paid by the Board. The opinion of the third physician shall decide the issue.
 

4) The opinion of all physicians consulted in determining medical necessity of the extended sick leave shall be submitted to the Board in the form of a sworn statement. All information contained in any statement from a physician shall be confidential and shall not be subject to the public records law.
 

SICK LEAVE FOR ASSAULT OR BATTERY
Any employee of the public schools who is injured and disabled while acting in his/her official capacity as a result of an assault or battery by any student or person shall receive sick leave without reduction in pay, and without reduction in accrued sick leave days while disabled as a result of such assault and battery. The employee shall be required to provide a certificate from a physician certifying such injury and incapacitation. The sick leave authorized shall be in addition to all other sick leave authorized herein, shall not be accumulated from year to year, nor shall such additional sick leave be compensated for at death or retirement, or compensated for in any manner except as set forth above.
SICK LEAVE FOR PHYSICAL CONTACT WITH A STUDENT
Any teacher or school employee, but not a bus operator, who
is injured or disabled while acting in his official capacity as a result of physical contact with a student while providing physical assistance to a student to prevent danger or risk of injury to the student, shall receive sick leave for a period of up to ninety (90) days without reduction in pay and without reduction in accrued sick leave days while injured or disabled as a result of rendering such assistance. The teacher or employee shall be required to present a certificate from a physician certifying such injury or disability. The Board may extend the period of sick leave beyond ninety (90) days at its discretion.
SICK LEAVE/WORKERS' COMPENSATION
Should any teacher become injured or disabled while acting in his or her official capacity, other than by assault, the teacher shall be entitled to appropriate worker's compensation benefits and/or sick leave benefits, at the teacher's option, for the period of time while injured or disabled. Any benefits received, however, shall not exceed the total amount of the regular salary the teacher was receiving at the time of injury or disability. The teacher shall be required to present a certificate from a physician certifying such injury or incapacitation.
VESTING OF SICK LEAVE
 

All sick leave accumulated by a teacher or school employee, but not a bus operator, shall be vested in the teacher or school employee by whom such leave has been accumulated. In the event of the transfer of a teacher or school employee from one school system to another in Louisiana, or upon the return of such teacher or school employee to the same school system within five (5) years or such longer period that may be approved by the Board to which the teacher or school employee returned, regardless of the dates on which the leave was accumulated or the date of transfer or return of the teacher or school employee, such vested leave shall be transferred, returned to, or continued by the Board and shall be retained to the credit of the teacher or school employee.

Teaching certificate issued by the Louisiana Department of Education and any social worker or school psychologist employed by the Board who holds a valid professional ancillary certificate in social work or school psychology issued by the Louisiana Department of Education.

Any person employed by the School Board who operates a school bus transporting children under the supervision of the School Board.
School Employee:
Any person employed by the School Board who is not a teacher or whose employment does not require the holding of a teacher's certification or who is not employed as a bus driver.

The next item discussed was a poll of physicians' fees for CDL physicals for bus drivers.
 

Ron Hayes, Risk Manager, presented the Committee with a list of doctors (and their fees) who responded to a poll taken regarding the cost of CDL physicals for bus drivers.
 

Following discussion, a motion was made, seconded and carried to adopt a policy on reimbursing employees a designated amount for a physical for a CDL license and to refer the issue to the Budget/Fiscal Management Committee to determine that amount.

Shall School District No. 34 of Calcasieu Parish, Louisiana (the “District”) (i) levy and collect a special tax of five (5) mills for a period of twenty (20) years from the first levy of the tax, in excess of and in addition to other taxes levied by the District; and (ii) shall the District incur debt and issue bonds in an amount not exceeding $35,000,000 for a period not to exceed twenty (20) years from the date thereof, with interest at a rate not exceeding Nine (9%) percent per annum; said special tax, debt and bonds authorized for the purpose of acquiring and/or improving lands for building sites and playgrounds, purchasing, erecting, enlarging and/or improving school buildings and other school related facilities within and for the District, and acquiring the necessary equipment and furnishings therefor, title to which shall be in the public, which said bonds shall be retired with, paid from and secured by ad valorem taxes on all taxable property within the limits of the District sufficient in rate and amount to pay said bonds in principal and interest?

We therefore ascertained that the majority of qualified electors of School District No. 34 of Calcasieu Parish, Louisiana qualified to vote under the Constitution and laws of the State of Louisiana voting in said election in the District voted in against the Proposition.
 

At the same time and place, we did examine and canvass the returns as evidenced by said tabulation blanks, certificates, and statements received from the election Commissioners and Commissioners-in-Charge, the correctness of which were sworn to by the election Commissioners-in-Charge and Commissioners according to law, and our finding was that the returns indicated a majority voted against said proposition.
 

 
Therefore, we declare that the result of said election is against the Proposition as stated above.
 

In accordance with law, a resolution promulgating the aforesaid results was adopted, and the Secretary of the Board was ordered to have a copy of said resolution signed by the President and published in one issue of the Lake Charles American Press, a newspaper published in Calcasieu Parish and of general circulation in said School District No. 34.
 

We did, likewise, order that one copy of this proces verbal be sent to the Secretary of State to be recorded in the archives of the State of Louisiana, and that one copy be sent to the Clerk of the District Court of Calcasieu Parish to be recorded in the mortgage records of said Parish and that one copy be filed in the archives of this Board.
 

THUS DONE AND SIGNED in the presence of    Charlene Chiasson and          Joseph A. Delafield , competent witnesses and qualified voters of Calcasieu Parish on this 8th day of May, 2001, at a special meeting of the Board in Lake Charles, Louisiana, by the undersigned members of said Board present and participating in the canvass of said election.

RESOLUTION
 

A RESOLUTION PROMULGATING THE RESULTS OF A SPECIAL ELECTION HELD IN SCHOOL DISTRICT NO. 34 OF CALCASIEU PARISH, LOUISIANA ON MAY 5, 2001.
 

WHEREAS, on May 5, 2001, an election was held in School District No. 34 of Calcasieu Parish, Louisiana, to determine the proposition hereinafter set out;
 

WHEREAS, the returns of said election were canvassed by the Board according to law and notice duly given as provided by law, and the result of said election was declared to be against the proposition;
 

NOW, THEREFORE, BE IT RESOLVED by the Calcasieu Parish School Board, the governing authority of School District No. 34 of Calcasieu Parish, Louisiana, as follows:
 

SECTION 1. An election was held in School District No. 34 of Calcasieu Parish, Louisiana, on May 5, 2001, to determine the proposition hereinafter set out; that said election was duly and properly called by the Board by a resolution adopted on March 6, 2001 and recorded in the records of said Board, that notice of said election embracing all matters required by law to be contained therein was given by publication in the Lake Charles American Press, a newspaper published in Lake Charles, Louisiana, and of general circulation in School District No. 34, on March 14, March 21, March 28, and April 4, 2001, the first of said publications being not less than 45 days nor more than 90 days prior to the date set for said election; that this Board did in said resolution designate the polling places for said election and did provide for the use of voting machines in the conduct of said election; that election officials were duly selected; that each election official received the certificate of instruction of the use of the voting machines and his duties in connection therewith as required by law; that the State Custodian of Voting Machines and the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Calcasieu Parish made available on the day of the election at the polling places designated for the conduct of said election the necessary voting machines
and all necessary equipment and paraphernalia required by law in connection with the use of voting machines at elections; that the Registrar of Voters and the Clerk of Court of Calcasieu Parish furnished to the election Commissioners and Commissioners-in-Charge copies of the precinct registers for each precinct or ward entitled to vote at such polling places; that the Louisiana Secretary of State prepared and certified the ballot used in the voting machines as required by law; that the proposition voted on in said election and as it appeared in said voting machine was in due form provided by law and the resolution adopted by this Board on March 6, 2001, calling said special election; that the results of said election were written on a large sheet of paper at said polling places, which sheet of paper was signed by each of the election officials designated to conduct such election at said polling places and which sheet was thereupon posted in public view at the polling places in accordance with law; that only qualified electors under the Constitution and laws of the State of Louisiana voted at said election; that the officials who served at said election were duly and properly appointed; that the places of all absent election officials were properly filled in accordance with law; that before opening the polls all election officials were properly sworn in accordance with law; that the polls at the voting places were opened at 6:00 a.m. and remained open and until not later than 8:00 p.m.; that after the closing of the polls the votes for and against the proposition were properly counted and tallied and the necessary tabulation blanks, certificates and statements were made by the election officials in accordance with law and the voting machines delivered to the Clerk of Court and Ex-Officio Custodian of Voting Machines in and for Calcasieu Parish, Louisiana, and a copy of the results of said election delivered to the Clerk of the District Court of Calcasieu Parish as required by Louisiana Revised Statutes 18:1190 E; that on May 8, 2001, that being the third day after said election the Clerk of Court and Ex-Officio Custodian of Voting Machines, after breaking the seals and opening the voting machines used in said election did transcript the totals for the proposition voted upon at said election; and that all things whatsoever required by law to be done in connection with the holding of said election were properly and duly performed in manner and form as required by Chapter 4 of Subtitle II of Title 39 of the Louisiana Revised Statutes of 1950, as amended, and the general election laws of the State of Louisiana.
 

SECTION 2. In said election the following proposition was approved by a majority of the electors qualified to vote and voting in said election in School District No. 34 of Calcasieu Parish, Louisiana:
 

BOND AND TAX PROPOSITION
 

SUMMARY: AUTHORITY FOR SCHOOL DISTRICT NO. 34 OF CALCASIEU PARISH, LOUISIANA, (i) TO LEVY AND COLLECT A 20-YEAR SPECIAL TAX OF FIVE (5) MILLS IN ADDITION TO OTHER TAXES LEVIED BY THE DISTRICT; AND (ii) TO ISSUE NOT EXCEEDING $35,000,000 OF 20-YEAR PUBLIC SCHOOL IMPROVEMENT BONDS; BOTH FOR ACQUIRING AND/OR IMPROVING SCHOOL BUILDINGS AND OTHER SCHOOL RELATED FACILITIES WITHIN THE DISTRICT, SAID BONDS TO BE PAYABLE FROM AD VALOREM TAXES.

Thail Pete, Principal at the Career Center has reported that an additional $71,435 will be funded to the grant.
 

Pre-AP Summer Institute/Xavier University
 

A faculty team of seven from Ray D. Molo Middle and Washington Marion High School has been awarded a $7,000 grant for a Pre-AP Summer Institute at Xavier University this summer. It is a vertical team for educators in grades six through twelve who will work cooperatively to develop and implement a vertically aligned program aimed at helping students acquire the academic skills necessary for success in Advanced Placement English.
 

Participants are: Johnny Mouton, Principal, Molo Middle; teachers, Eunice Dent and Amy Reynolds; Madelyn Miller, Principal, Washington Marion; Andrea Green Perry, Counselor, Washington Marion; teachers, Dinah Robinson, Amelia Fontenot, and Linda Becton.
 

Duke Talent Identification Program
 

Twenty-eight seventh grade students took either the SAT or ACT in order to apply for the Talent Identification Program. Thirteen of these students received state recognition at a ceremony held at Northwestern State University.
 

Students receiving recognition were: Maplewood Middle - Allison Abbott, Ryan Carruth, Jason Doyle, Meagan Harris, Sarah Miller, Angela Thomas; S. J. Welsh Middle - Holly Albers, Trey Harts, Natasha Parekh, Elexa Richard, David Roeder, Anna Thomas, Lori Watson.
 

ANNOUNCEMENTS AND REQUESTS
 

Mr. Pitre requested that an item addressing dress policy for faculty and staff be placed on a committee agenda for discussion. He requested a letter of condolence to be sent to Joetta Banks, Cindy Courville and Sandy Hill. He announced that Barbe High had been chosen as one of the top twenty high schools to receive the LSU Golden Achievement Award. It is given to schools who earn the highest number of credits at spring testing at LSU. He requested a letter of congratulations to be sent to the Barbe High Girls Tennis team, Class 5-A, Region I State Champions; the Boys Team was the State Runner-up Class 5-A. Mr. Pitre requested a letter of congratulations to be sent to the S. J. Welsh Beta Club for attaining First Place in the Song Fest.
 

Mr. Karr said it was his pleasure to attend the banquet in honor of retiring teachers. He requested that everyone remember John Parker in their prayers.
 

Mr. Armentor requested a letter of congratulations to be sent to Bell City High Boys and Girls Track Teams for their outstanding performance at the State Track Meet. He announced that the Governor and his wife were hosting a motorcycle ride to raise monies for the Sunshine Foundation in order to purchase books on self-esteem that will be given to kindergarten students.
 

Mrs. Duplechin requested a letter of condolence to Mary Margaret David on the loss of her mother. She invited all Board Members to Oak Park Middle School on May 18, 2001, at 11:00, for the monthly Board luncheon.
 

Mr. Blackwell requested a letter of congratulations to be sent to the Sulphur High School Softball team upon winning the State Championship in Division 5-A; a letter of congratulations to the Boys Golfing Team upon winning the Division 5-A State Championship. He requested a letter of condolence to be sent to the family of Della Thistrup.
 

J. Duhon requested a letter of congratulations to be sent to the Vinton High School Baseball Team for winning the Championship in their District and advancing to the second round playoff games. He requested a letter of condolence to be sent to the family of Della Thistrup.
 

Mr. Victorian requested a letter of congratulations to be sent to the Lake Charles Boston Boys Track Team for winning the State Championship in District 3-A; congratulations to the LaGrange High School Girls Track Team for winning the Regional Meet.
 

Mr. Robert said he was concerned about the budget preparation not being presented until mid-June. He stated he would like to be sure multiple views on the budget were brought to the Board.
 

C. Duhon thanked Board Members who attended her installation as President of LSBA and presented her with flowers. She requested a letter of condolence to be sent to the daughter of Anna Stevens. Mrs. Duhon requested that a Resolution be prepared to be given to families of deceased employees of the Board at the time of the funeral services. She congratulated the Lake Charles Boston Boys Track Team. She requested that an item addressing students handbooks be placed on an upcoming Curriculum and Instruction Committee Agenda. Mrs. Duhon encouraged all Board Members to attend the May 22, 2001, Day at the Legislature.
 

Mr. Falgout thanked Greg Belfour, Attorney, who was sitting in for Mr. Spruel in his absence. He thanked Madolyn McCoy for her years' service to the Board.
 

Ms. LaVergne requested a letter of congratulations to be sent to Madolyn McCoy on her upcoming retirement. She announced that the High School Student of the Year, Brandi Gallien, Washington Marion High School, earned a 35 on the ACT test. She requested a letter of congratulations to be sent to Shauna and Clint Turner on the recent birth of quadruplets.
