DATE, TIME, PLACE OF MEETING

The Calcasieu Parish School Board met in the Conference Room of the Calcasieu Parish School Board located at 1732 Kirkman Street, Lake Charles, Louisiana, on Tuesday, October 17, 2000, at 5:00 p.m. The meeting was called to order by Wilridge P. Doucet, President. The prayer was led by Gregory P. Robert; Wilridge P. Doucet led the Pledge of Allegiance.

ROLL CALL

The roll was called and the following members were present: Joe A. Andrepont, Randall C. Armentor, Ricky Blackwell, G. Michael Canaday, Wilridge P. Doucet, Clara F. Duhon, Jay L. Duhon, Carla C. MINUTES APPROVED

On motion by Mr. Karr, seconded by Mr. Andrepont and unanimously carried, the minutes of the regular meeting of October 3, 2000, were approved as presented.

RECOGNIZE SCHOOL REPRESENTATIVES

Mr. Doucet recognized representatives present from the following schools: Henry Heights, Prien Lake, E. K. Key and Fondel Elementary; Reynaud Middle.

PRESENTATIONS

AIA Southwest Louisiana Grant

Gayle Zembower, AIA, stated that each year the AIA Louisiana Southwest presented an annual grant award available to Calcasieu Parish teachers. The grant is given with the spirit of encouraging architectural education through teacher and student awareness. It was designed to encourage the development of a short curriculum of instruction involving architecture and/or architects. Due to the number of excellent submissions, this year the grant was presented to Paula Taylor, Moss Bluff Middle School and Gloria Rascoe, W. W. Lewis Middle School.

Outstanding School Support Employee

Dolores Hicks, Administrative Director, Elementary Schools, announced the Outstanding School Support Employees of 2000-2001 for Calcasieu Parish Schools.

Elementary School Division

Janice Breaux, E. K. Key Elementary Cafeteria Manager was named Elementary School Division Outstanding School Support Employee of Calcasieu Parish for 2000-2001. Mrs. Breaux was unable to attend due to a serious illness in the family. Robert Vizina, Principal, E. K. Key Elementary, received the plaque on behalf of Mrs. Breaux.

Middle School Division

Tammy Gaspard, Vinton Middle School Secretary/Bookkeeper was named Middle School Division Outstanding School Support Employee of Calcasieu Parish for 2000-2001. Ms. Gaspard was presented a plaque in recognition of the honor.

High School Division

Jacqueline Grogan, Iowa High School Cafeteria Manager was named High School Division Outstanding School Support Employee of Calcasieu Parish for 2000-2001. Ms. Grogan was presented a plaque in recognition of the honor.

Principal of the Year

Dolores Hicks, Administrative Director, Elementary Schools, presented the 2000-2001 Calcasieu Parish Principals of the Year.

Cynthia Creel, DeQuincy Elementary School, was named Elementary Division Principal of the Year. In addition, Mrs. Creel was selected as the Regional Elementary Principal of the Year.

Ellaweena Woods, Reynaud Middle School, was named Middle School Division Principal of the Year.

Gerald Conner, Sulphur High School, was named High School Division Principal of the Year. In addition, Mr. Conner was selected as the Regional High School Principal of the Year.

Teaching & Technology Conference Overview

Sheryl Abshire, Coordinator of Technology and the Technology Department staff, presented an interesting overview of a recent Teaching and Technology Conference held recently at the Tech Center and J. J. Johnson Elementary.

Mr. Karr congratulated Mrs. Abshire and the technology personnel. He said that every opportunity should be taken to know what is going on in Calcasieu Parish and how employees give of their time and talents.

COMMITTEE REPORTS

Budget/Fiscal Management Committee

Sheral LaVergne, Chair, reported that the Budget/Fiscal Management Committee met on Tuesday, October 10, 2000; a quorum was present.

The first item of discussion was new laws enacted by the legislature in 1999 on sabbatical leave and Gayle pay. New laws required calculations by local school systems to determine if monetary savings were created by the new procedures in 1999-2000, compared to the previous four-year average costs under the old law. It was required that calculations and results should be presented and approved by each local school board with any savings actually distributed to teachers. Act 1341 dealt with the amount of pay a teacher or bus driver actually received when missing additional sick days after using all allocated sick leave. The employee would be paid the difference between their regular daily rate of pay and the cost of a substitute hired. This process was called Gayle Pay. During the 1999 legislative session, the "Green Pay" law was enacted that eliminated Gayle Pay and replaced it with 90 days of additional sick leave to use over a six year period for all teachers and bus drivers. The employee would be paid 65% of their daily rate of pay and docked 35% for each of 90 days used once they exhausted their regular sick leave. The 1999-2000 costs calculated for 90 day extended sick leave were ($283,034.13) more than the four-year average cost of Gayle Pay; no payment is due by the system. Act 1342 was also approved by the legislature doing away with the Rest and Recuperation Sabbaticals and replacing them with Medical Leave Sabbaticals. Under the old Rest and Recuperation Sabbatical, a teacher was docked the daily pay of a certified substitute ($48) and under the new law, a teacher is docked 35% of their regular daily rate of pay. The Act also required the calculation comparing expenditures for the new Medical Leave to the four-year average cost of Rest and Recuperation Sabbaticals for 1995-1999. The 1999-2000 costs of Medical Sabbaticals were ($108,407.66), more than the four-year average cost of Rest and Recuperation Sabbaticals; no payment was due by the system.

Ms. LaVergne moved, on behalf of the Committee to approve the results of the calculations for Acts 1341 and 1342 of 1999, as presented. Motion carried unanimously.

Ron Hayes, Risk Manager, addressed the Committee, advising that there would be no increase in the renewal of the Income Protection Plan for the upcoming year and the renewal date had been extended to November 1, 2001.

Ms. LaVergne moved, on behalf of the Committee to approve the renewal of the Voluntary Income Protection Plan through Protective Life Insurance, as presented. Motion carried unanimously.

Ms. LaVergne moved, on behalf of the Committee to approve a request for matching funds from Riverboat Funds, for construction of an agriculture shop and classroom at Vinton High School, not to exceed $20,000. Motion carried unanimously.

Budget Revision #1 to the FY 2000-2001 General Fund was presented. New projected revenue after the approval of the revision would be $156,195,055, with estimated expenditures at $157,191,037, leaving a projected deficit of $995,982.

Ms. LaVergne moved, on behalf of the Committee to approve Budget Revision #1 to the 2000-2001 General Fund Budget as presented. Motion carried unanimously.

Jean Johnson, President of the Calcasieu Federation of Teachers addressed the Committee regarding the issue of a local pay raise for teachers and support personnel. No action was necessary on this item.

A request was made by the Chennault International Airport Authority asking the Board to support proposed legislation that would seek an exception to the Louisiana Open Meetings Law permitting matters of confidential and proprietary information relevant to economic development to be discussed in Executive Session and not disclosed until matters have been resolved. This exception would allow the Chennault International Airport Authority to compete in the private sector by negotiations remaining private and confidential.

Ms. LaVergne moved, on behalf of the Committee to approve the request from the Chennault International Airport Authority. Motion carried unanimously.

Ms. LaVergne moved, on behalf of the Committee to approve requests for Permission to Advertise for the sale of surplus used computer equipment, used pallets and used school lunch equipment. Motion carried unanimously.

Ms. LaVergne moved, on behalf of the Committee to approve a request by the Lake Charles Police Department for the Board to endorse the Local Law Enforcement Block Grant as presented. The program will provide funding through the Bureau of Justice Assistance of the U. S. Department of Justice to provide units of local government with funds to underwrite projects to reduce crime and improve public safety. The $189,757 grant awarded to Lake Charles is based on the average annual amount of Par 1 crimes compared to all other local jurisdictions in the state for the three most recent calendar years. No funding is requested. Motion was voted on and carried unanimously.

Ms. LaVergne moved, on behalf of the Committee to approve a request by Pure Reef, L.P. for the nomination of 3.71 acres located in Section 3, T11S. R6W(Bell City/Hayes area) for an Oil, Gas and Mineral Lease and a request by Basin Properties, Inc., for the nomination of lands located in Section 16T10S, R13W (640 acres in Sabine area) for an Oil, Gas and Mineral Lease, as presented. Motion carried unanimously.

President, Wilridge Doucet, called the meeting to order and on roll call, the following members were present:

A RESOLUTION ORDERING AND CALLING A SPECIAL ELECTION TO BE HELD IN SCHOOL DISTRICT NO. 26 OF CALCASIEU PARISH, LOUISIANA, ON JANUARY 20, 2001, AUTHORIZING THE INCURRING OF DEBT AND ISSUANCE OF BONDS OF SAID DISTRICT; AND MAKING APPLICATION TO THE STATE BOND COMMISSION AND UNITED STATES ATTORNEY GENERAL IN CONNECTION THEREWITH.

WHEREAS, it is deemed necessary and desirable by the Calcasieu Parish School Board, governing authority of School District No. 26 of Calcasieu Parish, Louisiana, (the "District"), that bonds of the District be issued in the sum of not to exceed SEVEN MILLION NINE-HUNDRED TWENTY-FIVE THOUSAND AND NO/100 --------------($7,925,000) DOLLARS, for the purpose of acquiring and/or improving land and playgrounds, purchasing, erecting, enlarging and/or improving school buildings and other school related facilities within and for said School District, and acquiring the necessary equipment and furnishings therefor, title to which shall be in the public; and

WHEREAS, authority for the issuance of the bonds of the said School District for such purpose is granted by Article 6, Section 33 and Article 7, Section 26(E) of the Constitution of 1974 of the State of Louisiana, by those portions of Part II not repealed by the 1977 Louisiana Legislature and Subpart A of Part III of Chapter 4 of Sub-Title II of Title 39 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority supplemental thereto, provided issuance of such bonds is first authorized by a majority of the qualified electors of the district voting on the proposition at an election to be held for such purpose; and

WHEREAS, the Calcasieu Parish School Board desires to provide for the holding of an election at which the proposition of issuing such bonds may be submitted; and

NOW, THEREFORE, BE IT RESOLVED by the Calcasieu Parish School Board, acting as the governing authority of School District No. 26 of Calcasieu Parish, Louisiana:

SECTION 1. Subject to the approval of the State Bond Commission, and under the authority conferred by Article 6, Section 33 and Article 7, Section 26(E) of the Constitution of 1974 of the State of Louisiana, those portions of Part II not repealed by the 1977 Louisiana Legislature and Subpart A of Part III of Chapter 4 of Sub-Title II of Title 39 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority supplemental thereto, a special election be and is hereby called and ordered to be held in School District No. 26 of Calcasieu Parish, Louisiana, on Saturday, the 20th day of January, 2001, between the hours of six (6:00) o'clock a.m. and eight (8:00) o'clock p.m., in compliance with the provisions of Section 1181 of Title 18 and of Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and that at said special election there be submitted to all the qualified electors of School District No. 26 entitled and qualified to vote at said election under the Constitution and laws of the United States, the following proposition:

BOND PROPOSITION

SUMMARY: AUTHORITY FOR SCHOOL DISTRICT NO. 26 OF CALCASIEU PARISH, LOUISIANA, TO ISSUE NOT EXCEEDING $7,925,000 OF UP TO 20-YEAR PUBLIC SCHOOL IMPROVEMENT BONDS FOR ACQUIRING AND/OR IMPROVING SCHOOL BUILDINGS AND OTHER SCHOOL RELATED FACILITIES WITHIN THE DISTRICT, SAID BONDS TO BE PAYABLE FROM AD VALOREM TAXES.

Shall School District No. 26 of Calcasieu Parish, Louisiana, incur debt and issue bonds in an amount not exceeding $7,925,000 for a period not to exceed twenty (20) years from the date thereof, with interest at a rate not exceeding twelve (12%) percent per annum, for the purpose of acquiring and/or improving lands for building sites and playgrounds, purchasing, erecting, enlarging and/or improving school buildings and other school related facilities within and for said School District, and acquiring the necessary equipment and furnishings therefor, title to which shall be in the public, which said bonds shall be retired with, paid from and secured by ad valorem taxes on all taxable property within the limits of School District No. 26 of Calcasieu Parish, Louisiana, sufficient in rate and amount to pay said bonds in principal and interest?

SECTION 2. The polling places set forth in the Notice of Special Election in Section 4 hereof, be and the same are hereby designated as the polling places at which to hold such election.

SECTION 3. Officers designated or such substitutes as may be selected, designated and sworn in compliance with Sections 1286 through 1289 of Title 18 of the Louisiana Revised Statutes of 1950, as amended, shall hold the said election substantially in accordance with the general election laws of the State of Louisiana, except that the election is called and shall be conducted, canvassed, and promulgated, and notice thereof given in accordance with the procedures set forth in Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended. Said election officers shall make due returns of said election at a regular meeting of the Calcasieu Parish School Board, to be held at its regular meeting place, the School Board Office, Lake Charles, Louisiana, on Tuesday, the 23rd day of January, 2001, at 5:00 o'clock p.m., at which time said School Board will, then and there, in open and public session, examine and canvass the returns and declare the result of said special election. The compensation of election officials be and the same is hereby fixed at the sum as specified in Sections 424 and 425 of Title 18 of the Louisiana Revised Statutes of 1950, as amended. Assessed valuations shall not be voted in this election, and all qualified electors of said School District No. 26 of Calcasieu Parish, Louisiana, are entitled to vote therein. Voting machines shall be used in this election, and voters shall not be required to sign a ballot or vote assessed valuation of property. The permanent registration law of the State of Louisiana being in force in Calcasieu Parish, said election shall be conducted in accordance with applicable provisions thereof.

SECTION 4. The Secretary of the Calcasieu Parish School Board is hereby empowered, authorized and directed to publish, entirely separate and apart from any publication which may be made of this resolution, once a week for four consecutive weeks, with the first publication not less than forty-five days nor more than ninety days before the date of the election, in the Lake Charles American Press a newspaper published in Lake Charles, Louisiana, and having general circulation in Calcasieu Parish and in School District No. 26 of Calcasieu Parish, Louisiana, a Notice of Election, substantially in the following form:

SECTION 5. The Secretary of the Calcasieu Parish School Board be and he is hereby empowered, authorized and directed to arrange for furnishing said election officers, in ample time for holding of said election the necessary equipment, forms and other election paraphernalia essential to the proper holding of said election.

SECTION 6. Application is hereby formally made to the State Bond Commission, Baton Rouge, Louisiana, in compliance with the requirements of Chapter 2, Title 47 of the Louisiana Revised Statutes of 1950, as amended, and in compliance with Article 6, Sections 29, 30 and 32 of the Constitution of 1974 of the State of Louisiana, and other Constitutional and statutory authority supplemental thereto, for consent, approval and authority to hold the aforesaid election in School District No. 26 of Calcasieu Parish, Louisiana, under the provisions of Article 6, Section 22 and Article 7, Section 26(E) of the Constitution of 1974 of the State of Louisiana, those portions of Part II not repealed by the 1977 Legislature and Sub-Part A of Part III of Chapter 4 of Sub-Title II of Title 39 of the Louisiana Revised Statutes of 1950, as amended, and other Constitutional and statutory authority supplemental thereto, and in the event such election carries, for its consent and authority to levy and collect the ad valorem taxes therein provided, and to issue bonds to be retired with, paid from and secured by said ad valorem taxes on all taxable property within the limits of School District No. 26 of Calcasieu Parish, Louisiana, sufficient in rate and amount to pay said bonds in principal and interest as they respectively mature. The Secretary is empowered, authorized and requested to forward to the State Bond Commission a certified copy of this resolution which shall constitute a formal application to said Commission as herein provided.

SECTION 7. A certified copy of this resolution, together with other showings required by Section 5 of the Voting Rights Act of 1965 and Regulations pertaining thereto (28 C.F.R. Part 51) shall be submitted to the United States Attorney General, for approval in compliance with the said Voting Rights Act, should such a submission be required.

SECTION 8. Certified copies of this Resolution shall be forwarded to the Secretary of State, the Commissioner of Elections, the Clerk of Court and Ex-Officio Custodian of Voting Machines in and for the Parish of Calcasieu, and the Registrar of Voters, as notification of the special election herein called in order that each may prepare for said election and perform their respective functions as authorized and required by law.

SECTION 9. All resolutions, ordinances, or orders in conflict herewith, be, to the extent of such conflict, and they are hereby repealed.

RESOLUTION

A RESOLUTION FOR THE EMPLOYMENT OF SPECIAL BOND COUNSEL.

BE IT RESOLVED by the Calcasieu Parish School Board, acting as the governing authority of School District No. 26 of Calcasieu Parish, Louisiana, as follows:

SECTION 1. There being a real public necessity for the retention and employment of legal counsel to provide specialized legal services as described in Section 2 hereof, in connection with acquiring and/or improving land and playgrounds, purchasing, erecting, enlarging and/or improving school buildings and other school related facilities within and for said School District, and acquiring the necessary equipment and furnishings therefor, title to which shall be in the public (the "Project"), for the benefit of all its citizens, requiring issuance of Public School Improvement Bonds (hereinafter referred to as the "Bonds") by School District No. 26 of Calcasieu Parish, Louisiana (the "Issuer"), and it appearing that the public interest requires obtaining of such specialized legal services, Joseph A. Delafield, Attorney at Law, of Lake Charles, Louisiana, ("Bond Counsel"), is hereby employed in accordance with the provisions of this resolution.

SECTION 2. Legal services to be provided hereunder include comprehensive legal and coordinate professional work described in Paragraphs (A) through (K) as follows:

(A) assisting in planning the financing and structuring the bond issue, and where appropriate, preparing enabling legislation or constitutional amendments;

(B) drafting and submitting to the Issuer all proceedings, documents and forms necessary in connection with the calling and ordering of the election to authorize the issuance of the Bonds;

(C) assisting officials of the Issuer and Commissioners and Clerks of Election in conducting the election and in canvassing the result thereof;

(D) processing applications for approval of bond election and issuance of the Bonds by state boards and federal authorities having jurisdiction, including the Civil Rights Section of the Department of Justice of the United States;

(E) drafting all proceedings and documents, including resolutions, indentures and ordinances necessary to authorize the issuance of the Bonds and all legal proceedings and documents relating to the marketing and delivery of the Bonds, and supervising the adoption of said proceedings, and execution of said documents by the officials of the Issuer;

(F) assisting the local counsel to the Issuer or local associate counsel retained by Issuer in handling all litigation affecting the legality of the bonds and/or the method of financing;

    1. assisting the Issuer or others in various aspects of preparing the Official Statement or any other disclosure document to be disseminated in connection with the sale of the Bonds;

(H) assisting in presenting information to bond rating organizations;

(I) arranging and supervising the delivery of the Bonds to the original purchaser thereof and, where required, the preparation and execution of trust documents safeguarding the expenditure of bond proceeds;

(J) obtaining any concurring or ancillary legal opinions from other persons or firms to enhance the possibilities of sale of the Bonds; and

(K) Preparing a complete transcript of record covering the issuance of the Bonds and furnishing the same to the purchaser(s) of the Bonds.

SECTION 3. The fee for the work to be performed hereunder is contingent upon the issuance, sale and delivery of the Bonds, and shall be in accordance with the maximum fee schedule of the Attorney General of the State of Louisiana for comprehensive legal and coordinate professional work of bond attorneys and bond counsel in the issuance of general obligation bonds. Should a bond election be requested in order to issue the bonds and complete the project, and that bond election fails one or more times, Bond Counsel nevertheless shall continue to provide legal services until the project is successfully accomplished. Bond Counsel shall pay out their fee the following expenses: (a) Travel and communication expenses incurred by them in the handling of the Bonds; (b) Cost of bond election proceedings; (c) Printing and reproduction costs of all financial analysis, reports, and legal proceedings prepared by the Bond Counsel. Bond Counsel shall be reimbursed all other reasonable and necessary costs and expenses incurred in connection with the preparation and distribution of any preliminary and final Official Statements containing detailed and comprehensive financial and statistical data with respect to the Issuer (for example, costs and expenses to include the cost of collecting data, cost of preparing and assembling material, costs of printing or duplicating, postal supplies, and cost of binding copies of the transcript of proceedings).

SECTION 4. It is intended that acceptance and approval of this resolution by entering upon performance by Joseph A. Delafield, Attorney at Law, of the legal services provided for herein, shall constitute this resolution a contract in accordance with the provisions hereof.

 

 

SECTION 5. When the Issuer has received payment in full for the Bonds upon delivery thereof, payment of the fee and expenses is authorized to be made as herein provided.

SUPERINTENDENT'S REPORT

1999-2000 School Report Card

Governor Mike Foster will release 1999-2000 School Report Card information on all Louisiana public elementary and middle schools at 10:00 a.m. on Wednesday, October 18.

In Calcasieu Parish we have scheduled a press conference at 3:00 p.m. on Thursday, October 19, in the Board Room with area media and Calcasieu Parish K-8 principals to issue 1999-2000 School Report Cards. Principals will receive a single copy of the School Report Card to Parents that will arrive in the district in November to be sent home to parents. Calcasieu parents will receive their School Repot Cards at the same time they get second six weeks student report cards.

This is the second year in the first three-year Louisiana Accountability cycle. Each school will receive a new School Performance Score and will be able to determine how well the school is progressing toward meeting its two-year Growth Target set last year. However, these 1999-2000 scores will not be included in the computation when the Growth Target measure counts for every school next year.

Accountability Plan for Low-Performing Schools – Fall 2000

The 1999-2000 School Report Card will be an interim report on all Louisiana public elementary and middle schools. This report follows the baseline report set in 1998-99 and culminates with the end of Cycle I reporting for the 2000-2001 School Performance Scores to determine if schools have met their growth targets. All elementary and middle schools that have a School Performance Score below 100 and have not reached their growth targets will be placed in corrective action.

In preparation for the corrective action, a long-range plan of assistance for schools with low School Performance Scores and/or those at risk of not reaching their growth target has been developed. Using the data that composes the compilation of the School Performance Scores for the 1999-2000 year, eight schools have been identified that are possibly at risk. Calcasieu Parish School Board’s Accountability Department, in conjunction with Region V Service Center, will work with the eight District Assistance Teams chosen to assist those schools (November 2000 to September 2001). The identified schools are:

John J. Johnson Elementary

Pearl Watson Elementary

Combre/Fondel Elementary

Molo Middle School

Oak Park Middle School

Reynaud Middle School

Louisiana Elementary Counselor of the Year

Kathleen Pias, Gillis Elementary, was named as the Elementary Counselor of the Year. Mrs. Pias will compete at the national level with the American School Counselor Association.

ANNOUNCEMENTS/REQUESTS

Mrs. Duplechin requested that an item be placed on the Administration and Personnel Committee agenda regarding expenditures.

Mr. Andrepont stated that some of the schools’ windsocks were in bad condition and asked Ron Hayes, Risk Manager, if the Risk Management Department had any available. He requested a letter of condolence to be sent to Mr. & Mrs. Paul Musgrove in the loss of their son. Mr. Andrepont congratulated Mr. Canaday for his recent election as 14th Judicial District Judge.

Mr. Falgout congratulated Mr. Canaday on his recent election as judge.

J. Duhon congratulated Mr. Canaday. He requested that two Ad Hoc Insurance Committee meetings be scheduled in November and asked that the Insurance Consultant, Mr. Taylor be present at those meetings.

Mr. Blackwell congratulated Mr. Canaday.

C. Duhon congratulated Mr. Canaday on his recent election. She requested information on the District Assistance Teams, where their training would be held, who was being trained and what was the plan to provide corrective action to schools. She requested information regarding obtaining new flags for schools who were in need of one. She said the Calcasieu Unit of Retired Teachers representative to the Ad Hoc Insurance Committee would be Laney Molo Prater.

Mr. Fontenot congratulated Mr. Canaday on his recent election and wished him well.

Mr. Robert requested a copy of the slide presentation presented by Mr. Rombach recently on school finances. He asked that a presentation be made at an upcoming Budget/Fiscal Management Committee meeting.

 

 

 

Ms. LaVergne requested a letter of condolence to be sent to Esther Stills and Joyce Edwards on the loss of their brother. She asked for a copy of the information requested by Mrs. Duhon on the District Assistance Teams.

Mr. Canaday extended his condolences to Mr. & Mrs. Paul Musgrove on the loss of their son.

Mr. Andrepont requested that Mr. Rombach be invited to make a presentation on school finances at an upcoming Budget/Fiscal Management Committee meeting. Mrs. Duhon asked that someone be present to verify Mr. Rombach’s statements.

Mr. Doucet congratulated Mr. Canaday on his recent election.

Resignation of G. Michael Canaday

G. Michael Canaday, Board Member, District 6, submitted his resignation to the Board. Mr. Canaday stated that he was resigning to take on the new duties and responsibilities as 14th Judicial District Judge. He said he was leaving a position that had become a large part of his life; that he had enjoyed all that the Board had been through in the system. He asked Board members to look at the activities and needs of District 6 when naming his replacement and to pick the person who would make the best impact. Mr. Canaday thanked each Board member for helping him to grow and who helped make his election possible.

G. Michael Canaday then stated that he was formally resigning his position as the elected School Board Representative of District 6, Calcasieu Parish, Louisiana, to assume his duties as 14th Judicial District Judge.

Mrs. Duhon moved, seconded by Mr. Robert and unanimously carried to approve the resignation of G. Michael Canaday, Board Member, District 6.

Jude W. Theriot, Superintendent, then asked Mr. Canaday to come forward. He thanked Mr. Canaday for his service stating he gave of his time generously, cared deeply about the children of Calcasieu Parish and gave 110% himself.

 

Mr. Doucet then presented a plaque to Mr. Canaday on behalf of the entire Board, commemorating his dedication and service to Calcasieu Parish Schools.

Mr. Canaday thanked the Board stating that he would display the plaque proudly.

Election of School Board Member, District 6

James Spruel, Legal Counsel, advised the Board that in the event a school board member resigned with an unexpired term of more than one year, the remaining board members must fill the vacancy within ten days of the resignation. A proclamation shall be adopted indicating there is a vacancy and because the unexpired term is more than one year, someone must be appointed until a special election can be called. He further stated that the procedure would be to fill the vacancy, then adopt a proclamation.

A lengthy discussion followed with regard to the appropriate time to fill the vacancy. Some felt there was not enough notice given in order that those interested might apply for the position.

Mr. Andrepont then moved, seconded by Mrs. Duplechin, to postpone consideration of filling the vacant seat until October 24, 2000.

Further discussion followed with J. Duhon offering a substitute motion, seconded by Mr. Blackwell, to change the meeting date to fill the vacant school board seat, from October 24, 2000 to October 23, 2000. Mr. Duhon stated it would be an injustice if the selection were made at this time.

Mr. Falgout then offered a second substitute motion, seconded by Mrs. Duhon, to allow the Board to take a 30 minute recess in order that the applications for the vacancy could be reviewed, hear from the applicants and select someone to fill the vacancy in District 6.

After additional discussion, the second substitute motion, to recess for 30 minutes in order to review the resumes of the applicants, reconvene and allow applicants to state their qualifications with a questioning period by the Board to follow, was voted on and carried by majority vote. YEAS: Mr. Armentor, C. Duhon, Mr. Falgout, Mr. Fontenot, Ms. LaVergne, Mr. Pitre, Mr. Robert and Mr. Victorian. NAYS: Mr. Andrepont, Mr. Blackwell, Mr. Duhon, Mrs. Duplechin and Mr. Karr. Due to the passage of the second substitute motion, the motion and first substitute motion was moot.

The Board recessed at 7:00 p.m., for 30 minutes to review the applications. Board reconvened at 7:30 p.m.

The following applicants for the District 6 School Board Member seat gave a brief overview of their qualifications followed by questions posed by Board Members: Anthony Biagas, John Broussard, Cindy Canaday, Mark Fontenot (represented by his brother-in-law, Chet Soileau), Bob Graham, Robert Hinton, Antonio Rogers, Philip Tarver, and Jerry Thompson.

Following the presentations, voting rounds were held with the person/s receiving the lowest number of votes in each round being eliminated.

John Moffet, Jr., was recognized by the Board. Mr. Moffett stated that the nine candidates were all highly qualified and he felt the Board would make the right decision.

The voting proceeded as follows:

Round I – 8 votes per Board Member: Biagas – 9; John Broussard – 4; Cindy Canaday – 10; Mark Fontenot – 4; Bob Graham – 7; Robert Hinton – 9; Antonio Rogers – 13; Philip Tarver – 13; Jerry Thompson – 11.

Mr. Broussard and Mr. Fontenot were eliminated.

Round 2 – 6 votes per Board Member: Anthony Biagas – 10; Cindy Canaday – 11; Bob Graham – 6; Robert Hinton – 4; Antonio Rogers – 10; Philip Tarver – 10; Jerry Thompson – 6.

Mr. Hinton was eliminated.

Round 3 – 5 votes per Board Member: Anthony Biagas – 9; Cindy Canaday – 9; Bob Graham – 5; Antonio Rogers – 10; Philip Tarver – 10; Jerry Thompson – 6.

Mr. Graham was eliminated.

Round 4 – 4 votes per Board Member: Anthony Biagas – 9; Cindy Canaday – 9; Antonio Rogers – 9; Philip Tarver – 9; Jerry Thompson – 5.

Mr. Thompson was eliminated.

Round 5 – 3 votes per Board Member: Anthony Biagas – 8; Cindy Canaday – 8; Antonio Rogers – 8; Philip Tarver – 8

Vote resulted in a tie. Another round of voting was held.

Round 5 (2nd vote) – 3 votes per Board Member: Anthony Biagas – 8; Cindy Canaday – 8; Antonio Rogers – 7; Philip Tarver – 5.

Mr. Tarver was eliminated.

Round 6 – 2 votes per Board Member: Anthony Biagas – 8; Cindy Canaday – 8; Antonio Rogers – 7.

Mr. Rogers was eliminated.

Round 7 – 1 vote per Board Member: Anthony Biagas – 7; Cindy Canaday – 7.

Voting resulted in a tie. Another vote was taken.

Round 7 (2nd vote) – 1 vote per Board Member: Anthony Biagas – 7; Cindy Canaday – 7.

Round 7, 2nd vote resulted in a tie vote. The Board asked for a final vote.

Round 7 (3rd vote) – 1 vote per Board Member: Anthony Biagas – 7; Cindy Canaday – 7.

James Spruel, Legal Counsel, informed the Board that since a decision could not be made, the Governor would appoint someone to fill the vacancy in District 6.

Approval of Proclamation Calling for Special Election for Calcasieu Parish School Board Member, District 6

Since no decision was reached on an applicant to fill the District 6 vacancy, the Proclamation became a moot point.

On motion by Mr. Blackwell, seconded by Mr. Karr and unanimously carried, the meeting was adjourned at 9:45 p.m.
